The Kansas Legistlature is considering a bill that would require Phelps and his followers to stand further away when they protest at funerals. This bill hits right at the heart of the freedom of speech debate.

Dozens of opponents of gay rights turned out to protest at Matthew Sherphard's funeral and voice their opinions against Shepard. Now, eight years later, Phelps and his followers are picketing military funerals, saying that God is punishing the United States for being too tolerant of the gay community.

"We're not restricting anyone's ability to convey opposition to the war or any cause or support for the war or any cause. We're simply saying that there are places and times where it is more or less appropriate, " said Rep. Tom Sloan, R-Lawrence.

The proposed bill would make it illegal to picket a funeral within 300 feet of the site. Protesters would also be banned from picketing one hour before and two hours after the funeral.
